According to the legal document, on April 20, Martínez allegedly disseminated a video titled “Arnulfo Gutiérrez and his Sons, Active Investigation from the USA. Santiago, Political Mafia”, in which statements are made that the plaintiff qualifies as “defamatory, unfounded, and outrageous”.
Gutiérrez maintains that these publications not only attacked his honor and dignity, but also affected the image of his family, recognized for its history of contribution to the social and cultural development of Santiago. The complaint invokes articles 367 et seq. of the Dominican Penal Code, in addition to Law 53-07 on High Technology Crimes and Offenses and Law 61-32 on Freedom of Expression and Dissemination of Thought. Likewise, compensation of five million pesos (RD$5,000,000.00) is requested for damages, in accordance with article 297 of the Criminal Procedure Code, in addition to the corresponding criminal sanctions. It is recalled that Ángel Martínez has gained visibility on digital platforms for his controversial complaints and publications, in most cases, without evidence, which is why he faces multiple accusations of defamation and extortion.
