Chinese businessman arrested following Migration's lawsuit for damages

SANTO DOMINGO.– Chinese businessman Po Xie, legal representative of the Mudan store, located on Duarte Avenue in the National District, was arrested this Thursday in compliance with an order issued by the investigating judge Kenia S. Romero Severino, following a complaint filed by the General Directorate of Migration (DGM).

The arrest was carried out by intelligence and interdiction units of the DGM while the defendant was traveling on a road in the Villa Consuelo sector, by virtue of judicial order No. 001-June-2025. The arrest warrant was signed by the prosecutor Teresa García, attached to the Community Prosecutor's Office of Villa Consuelo.

Po Xie offered no resistance and was transferred to the DGM facilities, where the corresponding biometric registration was carried out, before being handed over to the Public Prosecutor's Office.

The legal action was prompted by a formal accusation from the DGM, which also constituted itself as a civil plaintiff, imputing Po Xie with the crimes of obstruction of immigration interdiction work and rebellion against public officials, in violation of provisions of the Penal Code, the Civil Code and the General Migration Law No. 285-04.

The file, prepared by the Legal Department of the DGM, indicates that the businessman allegedly assaulted the acting personnel during an immigration interdiction operation carried out on May 28 at the Mudan store. Among those affected are the employees Martín Juan Mateo Mora, Rosmel Daritza Matías and Lieutenant Colonel Alexander Cuevas De Óleo, members of the DGM brigade deployed at the site.

During the operation, which was supported by the Armed Forces and the National Police, 35 Haitian citizens who were working in an irregular migratory condition were arrested.

Additionally, the General Directorate of Migration imposed an administrative sanction on the company Mudan Confort Collection, equivalent to RD$450,000.00, for re-offending in the hiring of foreign labor in an irregular migratory situation.

The sanction was applied in accordance with the provisions of Law 285-04 and its Implementing Regulation No. 631-11, which contemplate fines of up to 30 minimum wages of the public sector for each proven infraction. According to the authorities, the fine has already been paid by those responsible for the company.
